Government Litigation
Messer Fort regularly represents government entities and their employees and officials in state and federal litigation. Our litigation attorneys have handled litigation matters in state courts across Texas, in most Texas’ courts of appeals, and before the Texas Supreme Court. When it comes to federal litigation, our attorneys have successfully represented clients in the Northern, Southern, Eastern and Western District Courts of Texas, before the Fifth Circuit Court of Appeals, and before the United States Supreme Court.
Governmental defendants are often entitled to legal defenses that provide for early dismissal of claims. When available, we seek to present those defenses early and aggressively, with the intent to obtain dismissal in a cost effective manner. If trial is necessary, we seek to work with the client to efficiently and effectively prepare the case to be presented to the judge or jury at trial. We are also prepared to pursue an appeal of an adverse ruling, or defending a successful outcome through another’s appellate challenge.
Our municipal legal team has the breadth and depth of knowledge on the significant legal issues facing local governments in litigation, including:
- Constitutional and Civil Rights Claims
- Declaratory Judgment/Ordinance Challenges
- Personal Injury/Property Damage
- Texas Tort Claims Act Claims
- Land Use and Zoning Litigation
- Quo Warranto/Municipal Incorporation Challenges
- Contract Disputes
- Construction Disputes
- Election Contests
- Eminent Domain
- Procurement Claims
- Open Meetings Act Claims
